Disclaimer regarding external healthcare facilities
1. Our service: Telehealth consultations only
Harmony Pharmaceutical provides over-the-phone medical diagnoses and connects you with a medical doctor for a telehealth consultation. We facilitate access to medical professionals who can provide a preliminary diagnosis, recommendations, and prescriptions. Our service does not extend to, and we have no control over, the treatment, conduct, or facilities of any third-party healthcare providers, hospitals, or clinics.
2. No liability for external facilities
By using our service, you acknowledge and agree that Harmony Pharmaceutical is not liable for any medical negligence, malpractice, misconduct, or injury caused by, or resulting from, the treatment you receive at any public or private health care facility in South Africa, including any facility to which you may be referred.
Our role is strictly limited to the telehealth services provided by our medical professionals and the platform used to connect you to them.
3. Your rights under the Consumer Protection Act (CPA)
In South Africa, the Consumer Protection Act (CPA) protects patients, who are considered consumers of medical services. This means that exclusionary clauses or waivers that attempt to strip you of your rights are often unenforceable. You retain the right to pursue a claim directly against the healthcare facility or professional responsible for any harm caused.
4. You assume the risk

By agreeing to seek in-person treatment at an external healthcare facility, you accept the risks associated with that facility's standards of care and resources.
5. Our responsibility for the telehealth consultation
While we are not liable for external facilities, Harmony Pharmaceutical remains responsible for the standard of care provided during your telehealth consultation. We warrant that our services are provided with reasonable care and skill. Any claim related to the quality of the telehealth consultation itself would fall under our responsibility, in accordance with South African law.
